Minnesota's cannabis legalization bill H.F. 100, which passed both the House and Senate in May 2023, will make Minnesota the 23rd state to legalize recreational marijuana. The bill establishes a regulatory framework for both adult-use cannabis and the lower-potency hemp-derived beverages and edibles that were legalized last year.

Changes to Minnesota's Cannabis Laws

Minnesota's cannabis legalization bill sets taxes on regulated products at 10%, lower than most legal states, and allows Minnesotans to home grow for the first time. Effective August 1, 2023, it reschedules marijuana under Minnesota law and allows for legal possession within certain limits. It also adds guardrails around the already-legal hemp-derived edible cannabinoid products, requiring testing, labeling, and eventually licensing to protect consumers.

It creates a process under which businesses can apply for licenses to grow, manufacture, process, and/or sell cannabis for adult use. Additionally, criminal penalties are amended and some past marijuana convictions can be expunged from individuals’ criminal records.
